Terms of business and conditions of sale

1) Payment to be made by bank transfer. No alternatives are available

2) Payment to be made within 2 working days of invoice date unless agreed otherwise in writing

3) All vehicles to be collected within 3 working days of invoice date. Delivery can be arranged at competitive prices

4) Vehicles are sold as seen with no warranty offered, given or implied. This is a trade sale not a retail sale. ‘Trade sale’ is a common term to describe the sale of a vehicle between two motor trade companies where both use their knowledge and expertise to ensure the vehicle is acceptable prior to payment. Any issues discovered at a later date are to be considered as the purchasers to rectify

5) Our description of the vehicle will apply to the physical cosmetic condition internally and externally as well as reporting any issues noted during a test drive that will be a minimum of one mile long. Our vehicles are appraised ‘on the ground’ as we have no ramps or mechanical inspection facilities on site. If you are not happy to purchase a vehicle on this basis please advise us immediately upon receiving your invoice and we will happily cancel the transaction with no penalties to the purchaser

6) Purchasing dealer to agree not to put the vehicle into road use until satisfactory checks have been completed to ensure suitability/road-worthiness. As such vehicle is to be considered as requiring restoration with purchasing dealer accepting cosmetic repair as described and viewed prior to payment as well as any unknown or unforeseen mechanical repairs that may be required either at point of purchase or within the purchasing dealers ownership of the vehicle (including subsequent resale to trade or members of the public)

7) The purchaser accepts the cosmetic and mechanical condition with no further recourse when one or all of the following have been carried out subsequent to receipt of vehicle invoice and terms of business;

i) Vehicle has been viewed by purchasing dealer or their appointed representatives and payment made either prior to or  at point of collection, regardless of whether an appraisal has been completed or not (including but not limited to sales staff, drivers, external collection companies/drivers)

ii) Vehicle has been viewed by purchasing dealer or their appointed representatives (as detailed in section i) and signed for as satisfactory on Car Trading Group Ltd / SYC  paperwork at point of collection regardless of whether an appraisal has been completed or not

iii) Vehicle has been viewed by purchasing dealer or their appointed representative and payment made either prior to or following delivery by Car Trading Group Ltd / SYC

iv) Vehicle has been viewed by purchasing dealer or their appointed representatives and signed for as satisfactory on Car Trading Group Ltd / SYC paperwork following delivery by Car Trading Group Ltd / SYC

v) Vehicle has been collected by the purchaser or delivered to them by Car Trading Group Ltd / SYC and the vehicle has been advertised for sale by the purchaser either through a trade platform, auction or retail sale, regardless of payment having been made or not

8) Once a vehicle has been collected from us or delivered to you and paperwork signed to this effect or payment made, it will be considered your acceptance of the quality and suitability of the vehicle. Any vehicle collected will not be released until funds are cleared. Any vehicle delivered where payment has not been made in advance will require our driver to wait with the keys and vehicle documents until the funds reach our account. Title of the vehicle will remain with Car Trading Group Ltd / SYC until such time as payment is received regardless of vehicle location

9) Odometer readings are noted on the invoice but exact vehicle mileage cannot be guaranteed. We can provide copies of any/all service documentation in our possession, mot history as well as National Mileage Register checks along with your invoice to help you satisfy that a vehicles odometer reading is likely to be accurate

10) Accident damage/repairs will be noted where visible during our inspection as stated above. As with all vehicles we are unable to guarantee any repairs it may have gone through prior to our ownership but will endeavor to advise if there is anything we can see externally. All vehicles are history checked through HPI and will be clear unless otherwise noted. Outstanding previous finance may have been cleared by ourselves or a third party in which case we will provide evidence of the payment made and assist you in gaining clearance as soon as possible

11) Returns are not accepted once any part of section 7 has been met

12) Any issues with the vehicle that become apparent at a later date that would form part of a purchasing dealers due diligence are not the responsibility of Car Trading Group Ltd. this includes, but is not limited to cosmetic, mechanical, vehicle history and ownership

13) We will ensure HPI checks are carried out prior to the vehicle coming in to our stock but it is the purchasers responsibility to carry out their own checks and cross reference this with the vehicle when presented at point of collection or delivery prior to completing any action in section 7 which will void any right to a return/refund in full or in part, regardless of the issue arising to be cosmetic, mechanical, HPI/history check based or anything such. We will complete our due diligence and ensure that, to the best of our knowledge and expertise there are no issues with the vehicle that a prudent buyer would wish to be aware of (subject to the appraisal noted in section 5)

14) These terms and conditions of business form the contract of sale between both parties and restrict the purchasers rights under the Sale of Goods Act in that it is the purchasers responsibility, in all areas, to agree that the purchase is ‘sold as seen’ with no warranty offered, given or implied. The transaction is to be treated in the same manner as an auction purchase with no additional indemnity provided.  It is the purchasers responsibility to satisfy themselves as to the condition of the goods, their suitability, that any descriptions provided are accurate and value the goods accordingly.  Any price indications offered by Car Trading Group Ltd / SYC should be checked and confirmed by the purchaser prior to any agreement being made in The event that an error has occurred
